SAN DIEGO, July 1 (UPI) -- A U.S. Marine stationed at Camp Pendleton in California has been acquitted of talking to a reporter about passing classified information to a civilian group.

Private Gary Maziarz pleaded guilty two years ago to mishandling classified information by giving it to the Los Angeles Terrorism Early Warning Group, a civilian law enforcement agency. A year later, when he was released from the brig, he was given an advisory order against discussing his conviction with the news media, and a commander explained the order was not a specific ban and said he should talk to a lawyer before making any statements.

David Brahms, Maziarz's lawyer, said a military jury acquitted Maziarz Monday of willfully disobeying an order and a lesser charge of simple disobedience, the San Diego Union-Tribune reported.

Before the court martial, a military judge ordered Union-Tribune reporter Rick Rogers to respond to a subpoena to testify from Brahms. Brahms eventually decided against calling Rogers as a witness.

Patrick Callahan, a lawyer Maziarz consulted before talking to Rogers, said after the verdict he believed the consultation was key to his acquittal, because the Marine had been relying on legal advice.
