HARRISBURG, Pa., May 14 (UPI) -- A Philadelphia judge was stupid to run a real estate business out of his chambers, his lawyer told the Pennsylvania Court of Judicial Discipline.

Lawyer Samuel Stretton urged the eight judges deciding Willis Berry's fate not to remove him from the bench, The Philadelphia Inquirer reported. At Wednesday's hearing, Stretton said that a finding Berry had brought the court into disrepute would be the judicial equivalent of the death penalty.

"This is something I put in the area of stupidity", Stretton said. "I don't see this as the kind of intentional misconduct."

Berry, a judge on the Court of Common Pleas, was running for the state Supreme Court in 2007 when the Inquirer reported that he not only supervised his real estate holdings, mostly dilapidated buildings in the city, out of his judicial chambers but used his secretary to deal with tenants while she was on government time. In 12 years, Berry was also cited more than 70 times for problems with his buildings, including one instance when the city took over a building because it was considered dangerous for tenants, the report said.
