Attorneys representing young Dominick Branch allege an engineer and a conductor, who are both named as co-defendants in the suit, were acting negligently on June 25, 2008, when their train ran over their client's foot, The (Portland) Oregonian said Sunday.

Branch maintains the accident occurred as he was playing near the train tracks in Portland. Four of the young boy's toes were amputated as a result of his injuries.

Branch's attorneys allege the two railway employees, identified only as John Doe 1 and John Doe 2, were operating the train at too high a speed, while also failing to notice their client or warn the boy of their approach via a whistle.

Union Pacific was negligent in relation to the incident because the railroad company failed to put up fencing and warning signs around the railroad tracks where the incident occurred, according to the suit.

The Oregonian said the Multnomah County Circuit Court lawsuit seeks nearly $6 million in damages.
