AURORA, Ill., Dec. 31 (UPI) -- The wife of a man killed in a March car crash says authorities in Kane County, Ill., should have detained the other driver in the crash prior to the incident.

The Chicago Tribune said Thursday Rhonda McKenzie, whose husband William died in the Illinois Highway 47 crash, is suing the Kane County sheriff's department and the other motorist, Linda Knotts, 45.

McKenzie maintains a Kane County deputy should had taken Knotts into custody on March 20 after stopping the woman for allegedly driving erratically.

Instead, Knotts was released with an improper lane usage citation and later drove her pickup truck into a vehicle driven by McKenzie's 54-year-old husband, killing the man.

McKenzie alleges in her lawsuit Knotts was driving under the influence at the time of the deadly crash.

According to court records, Knotts was not charged with DUI in the wake of the incident. She was issued four unspecified citations, the Tribune said.

Neither the Kane County sheriff's department nor Knotts offered comment on the suit.
