in two terror-related incidents in Denmark and India.

The U.S. Justice Department on its Web site said the 12-count "superseding indictment" returned Thursday alleged they participated in planning a terrorist attack against a Danish newspaper and the November 2008 attacks in Mumbai in which about 164 died including six Americans.

The Danish newspaper had carried cartoons of the Prophet Mohammed.

Named in the indictment were Ilyas Kashmiri, a Pakistani militant leader, retired Pakistani army Maj. Abdur Rehman Hashim Syed and Tahawwur Rana, 49, a Canadian citizen and a native of Pakistan now a Chicago resident, the department said.

Kashmiri, suspected of having links with al-Qaida, and Abdur Rehman were charged in the Denmark terrorism plot. Neither is in U.S. custody and their whereabouts currently are unknown.

Rana and fellow Chicagoan David Coleman Headley, formerly known as Daood Gilani who is facing similar charges, are already in custody.

Headley, 49, a U.S. citizen, has pleaded not guilty but has authorized the Justice Department to disclose he is cooperating in the investigation.

The indictment alleged in 2002 and 2003, Headley attended terrorism training camps in Pakistan and conspired with Lashkar-e-Toiba members and others, including Rana, Kashmiri and Abdur Rehman, in planning and executing the attacks in Denmark and India.

The indictment said Headley had changed his name, enabling him to present himself in India as an American who was neither Muslim nor Pakistani.
