The Denver Post said Thursday Zuton Lucero maintains while she repeatedly contacted Denver Human Services, she was unable to resolve issues regarding her son's Medicaid pharmacy benefits in order to get necessary medication for her son.

Lucero said starting in March 2008, her attempts to fill an Advair prescription for her son, Zumante, were denied. Without the medication, the condition of Lucero's son deteriorated and the child died last July.

Center for Law and Policy attorney Ed Kahn echoed Lucero's allegations the state-benefits system caused her son's death.

"The human system fell down", said Kahn, whose group is considering filing a lawsuit against the state of Colorado regarding alleged benefits delays. "They are responsible for this kid's death."

Denver Human Services spokeswoman Revekka Balancier told the Post her agency "feels the death of any child as a tragic loss."

"And our department tries very hard to prevent these kinds of tragic accidents."
