Kerrie Gray, 48, is now a patient in a mental hospital and can only be released if he is deemed harmless.

The appeals court rejected arguments by the railroads involved that damages cannot be owed based on an evil cause -- in this case the stabbing death of John Boultwood, The Times of London reported. Gray stabbed Boultwood after the other man, who was drunk, stepped in front of his car.

The stabbing in 2001 occurred two years after Gray was injured in a train collision in London that killed 31 people. Gray's lawyer produced evidence that his personality changed completely after the crash.

The court said Gray cannot receive payment for his hospital incarceration but can be compensated for the loss of earnings that result from it.

The appeals court reversed a ruling by the High Court, which must now decide on the amount to be paid.
