ROCKFORD, Ill., July 2 (UPI) -- The Chicago area man charged with having deadly pufferfish toxin in his possession made a brief appearance in federal court Wednesday.

James Marcus, attorney for Edward Bachner IV, of Lake in the Hills, appeared before a federal magistrate in Rockford to ask that Brachner's preliminary hearing be postponed until Monday so he could review the case, the Chicago Tribune reported.

Bachner, 35, is charged with the federal crime of illegally possessing a biological agent, tetrodotoxin, without a permit. The toxin can be produced by pufferfish or in a lab.

Appearing in an orange jail jumpsuit, Brachner waved to the dozen family members in the courtroom. He was being held without bail in the Ogle County Jail pending Monday's hearing.

"This is extremely serious, and he's taking it as such", Marcus said of his client. "His family is very supportive of their son. Clearly, everyone is shell-shocked."

Bachner was arrested by federal agents after he allegedly posed as a researcher to buy large quantities of pufferfish toxin. He could receive up to 10 years in prison if convicted.
